By accessing or using Eveco Trip's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

These Terms of Service apply to all users of the service, including riders, drivers, and corporate clients.

2. Definitions

For the purposes of these Terms:

• "Service" refers to Eveco Trip's electric mobility platform, including mobile applications and website
• "Rider" means a person who uses our service to book and take rides
• "Driver" means an independent contractor who provides transportation services through our platform
• "Account" means the unique account created for you to access our Service
• "Company" refers to Eveco Trip Pvt. Ltd.

3. User Accounts

Account Registration

To use our services, you must:

• Be at least 18 years old
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we determine that your continued use poses a risk to the Company, other users, or third parties.

4. Use of Service

Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

• Violate any applicable local, state, national, or international law
• Harass, abuse, or harm another person, including drivers and other riders
• Use the service for any fraudulent or illegal activity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service
• Use automated systems to access the Service
• Share your account credentials with others

Rider Responsibilities

As a rider, you agree to:

• Treat drivers and their vehicles with respect
• Pay all applicable fees and charges
• Provide accurate pickup and destination information
• Be ready at the pickup location at the scheduled time
• Follow all safety instructions and guidelines
• Not bring prohibited items into the vehicle

Driver Responsibilities

Drivers must:

• Maintain valid licenses and insurance
• Keep vehicles clean and well-maintained
• Provide safe and professional service
• Follow all traffic laws and regulations
• Maintain a minimum rating as specified by Eveco
• Complete background checks and verification processes

5. Payments and Fees

Pricing

Ride fares are calculated based on:

• Base fare
• Distance traveled
• Time duration
• Service type selected
• Local taxes and fees

Payment Methods

We accept various payment methods including credit/debit cards, digital wallets, and UPI. By providing payment information, you authorize us to charge your selected payment method for all fees incurred.

Cancellation and Refunds

Cancellation fees may apply based on the timing and circumstances of the cancellation. Refunds are processed in accordance with our Refund Policy and may take 5-10 business days to reflect in your account.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Eveco Trip and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law, Eveco Trip shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid to Eveco Trip in the 12 months preceding the claim.

Drivers are independent contractors, not employees of Eveco Trip. We are not responsible for the acts or omissions of drivers or third parties.

8. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding:

• The reliability, accuracy, or completeness of the Service
• The availability or uninterrupted access to the Service
• The quality or safety of transportation services
• The conduct of drivers or riders
• The compatibility of the Service with your devices

9. Indemnification

You agree to indemnify, defend, and hold harmless Eveco Trip, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or your use of the Service.

10. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

• First, informal negotiation between the parties
• If unresolved, binding arbitration in accordance with Indian law
• The courts of India shall have exclusive jurisdiction

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
